What is a “Set Aside”

A Set Aside is the same as a Dismissal

A DMV set aside order is the equivalent of a dismissal of the license suspension action.  The order means the DMV will not suspend or revoke your license and you are eligible for reinstatement of your driving privileges.  When you get this letter it means the hearing officer (DMV Judge) agreed with the attorney’s arguments and drops the suspension.


A “set aside“ of the DMV action means the DUI arrest and suspension will be removed from your DMV record, like it never happened.


Winning a DMV hearing is a tremendous victory considering the statewide set aside rate for DUI suspensions is less than 5%.
